  • Withdrawing a claim

    SOS!! I wish to withdraw my employment tribunal claim after taking further legal advice on board. The judge at the pillory hearing warned me of the issues in my case which is why I sought legal advice. However, it is now the weekend and the next ph hearing is on Monday! Will I be liable for court costs? I am very aware of withdrawing my claim at such a late date.
    Or is it better to do the primary hearing and it all goes wrong and the whole claim is dismissed?

    If you withdraw, you will have costs against you.
    Are the Respondents represented?
    Have they previously mentioned communications regards costs?
    Clearly you now believe your case is 'weak', why?

      Hi Migsmagoo you're cutting things a bit fine for Monday, if you add a bit of context about your situation I'm sure you can get some decent advice.

        You will.still need to attend the preliminary hearing as it is tomorrow, however if you habe had legal advice that your claim does not stand much chance of success the you can withdraw your claim at the hearing tomorrow.
