  • ET3 not submitted by respondent - how quick should I apply for summary judgement?

    As above, my ET1 has been sent to the respondent, their 28 days is up and after phoning the court i've been told they haven't submitted an ET3 or extension request. How quickly should I go about requesting summary judgement? if they submit an out-of-time extension request before I request summary judgement, is the request for summary judgement likely to be set aside?

    They have had 6 months since i raised my grievances with no investigation undertaken and dozens of management meetings to discuss my case, and every time I've sent something to the court I've always copied them directly - so I would want to contest an extension request if they submitted one, but does it still weaken my summary judgement claim if they get an extension request in first?

    If they were to send in an extension request then as with all correspondence to the Tribunal that needs to be copied to the other party, in which case you would or should be aware that they have done this. It would be then up to a Judge to decide whether or not, in the interests of justice and dependent on the reasons given for requesting the extension, to agree to this or not.

    Any application you make to the Tribunal in the absence of an ET3 would be for a default Judgement and likewise you would need to copy in the
