  • Unfair Treatment In The Workplace. What legal action can I take?

    This is my first post on here but as the title states, I am at a job I feel treats myself and other racialized employees unfairly. Is there any legal action I can take against them?

    I am basing this off multiple situations, one where multiple people were sent on break while 3 other racialized employees and I had worked between 11.5-13 hours and not gotten a single chance to sit or eat. This happens on a consistent if not daily basis. It feels rather exploitative that we are the only people scheduled long hours alongside inadequate breaks. When I voiced this complaint I was told that they don’t do 8 hour shifts despite them sending non-POC employees home after 8 hours or less. We also use a machine to cut potatoes that spins and cuts rather fast and aggressively yet no one was given a proper training course on safety or any other aspects of the workplace. Our first pay is delayed a month and that coupled with the fact that I have not received an offer letter or anything confirming my rate of pay even when I asked management makes it seem sketchy. When I told them my view on this in an email, they spoke with me the next day and told us that we could have one free meal a day and I got one 15 minute break for an 11 hour shift.

    Is there anything that I can do through a union, court or something of the sort to remedy this or get compensation? Any advice is appreciated.

      I am in Ontario, Canada but I don’t mind advice from other countries even if laws are a bit different. It gives me an idea where to look and whether any legal wrong is being done

          The point is that in all countries, discrimination law is created by statute. Different countries have different statutes which take different approaches. The advice to consult your union, if you are a member, is good.
