  • Sacked because of dbs

    Hi all

first time posting and I’d really appreciate some advice. My Daughter has just been sacked from an apprenticeship post. The reason they gave was because of her dbs. She has 2 offences, driving related after going off the rails due to her mental health. I’m not excusing her behaviour but she was banned from driving, paid her fine and has 12 months probation so she is paying for her mistake. She spent along time looking for work with lots of knock backs at the age of 20 she feels her life is over. She finally found her dream job as an apprentice dental nurse. She disclosed her offences at the time of her job offer and she has since started and signed her contract she has been in the job 4 weeks. They have now decided to sack her with immediate effect due to her dbs. Apparently according to her manager they were undecided whether to keep her on but decided to let her go.
This seems so unfair when she was open and honest from the beginning and they had all the information they needed.
Is this allowed to happen, can she appeal is there anything she can do? they paid her a months wage and notified her by a call.

Please be kind, she is fully aware of her mistakes and is paying for them.

any advice will be gratefully received.

Was your daughter's offer subject to satisfactory references, which in this instance, given the job, would include a DBS check?

The other issue for your daughter is that she has only just started the job and has not got two years employment so unless she could argue a protected characteristic then she has little grounds to do anything about it. Also they have paid her a months wages, which I presume is as set out in her contract.

My thought is that maybe, given that your daughter was honest about her offences, they should have considered this would impact her DBS check and maybe not have offered her the position until this was known.
