    Hi hope i can find an answer to this.
    Would it be fair for an employer to change a policy midway through a capability process and apply that to the on going process.

    If the change put you at a disadvantage then you could argue that it was unfair. Is the change directly relating to your case, or is it more general?

      Its a capability that was started in 2015 and ran up until July 2023 the policy appears to have been changed in 2019. I know that the policy was breached in 2015 by the initiating manager. The capability was re run multiple times due to many issues with the process and disability so i am unsure if the stopping and staring then the change could be considered unfair.

        Given that the capability process ended last July and the policy changed in 2019 not sure there is much you can do about it now.

          Thanks that makes it a bit clearer.I assume that the employer would need to stick to the policy rigidly.
