    Back again with yet another problem.

    Ok, ill try my best to explain.

    I joined a company and it's holiday policy is 21 days up to 5 yeats 25 days 5-10 years and 26 days after 10 years. The shifts were 6 on 2 off and banknholidays were to be worked if on rota at double time day in lieu, triple time or single time and 2 days lieu. If the bank holiday was on a rest day we would get a lieu day. Based on a 39 hour week 5 days a week. Overtime after 39 hours

    We changed shift pattern to 5 on 3 off the contacted hours changed to 42 hours per week over 4.5 days had written confirmation with all other terms and conditions remaining the same. The management then told us verbally due to shift change you lose 2 days holiday. No written confirmation to this day. This went on for 2 years.

    This year they decided to chamge the holiday days to holiday hours. They have changed the contarcted hours again to 43.75 over 4 5 days. Average. Tis was to accomodate a 10 hour average shift. So this works out at us getting hours based on time served

    0-5 years 43.75 x 4.2
    5-10 years 43.75 x5
    10+ years 43.75 x5.2

    So, I'm 8 years. Previously I got 25 reduces to 23 after shift change now I have 218.75 hours that have ti be taken in 10 hour days. So basically 22 days.

    My question is what is the minimum amount of holidays they have to give me. On those terms and working all.bank holidays im on rota for.

    I've tried the government website and used irregular hours. Not sure if that's correct or how to factor in bank holidays.

    Not sure if this answers your question but the statutory minimum holiday entitlement is 20 days plus 8 days banks holidays.

      Thanks. I get that's fir a normal 5 day week. As our week is averaged out over 4.5 days as its 5 on 3 off is that the same entitlement.

      Also, we are expected to work bank holidays so we get the 20 but not the 8 bank holidays, unless the extra payment in lieu counts?

        The minimum entitlement of 20 days plus 8 days bank holidays or 5.6 weeks paid holiday is the same although your company seems to apply an entitlement to additional holiday based on length of service which also needs to be factored in.

        If you are expected to work a bank holiday then your first post sets out that you will get "double time day in lieu, triple time or single time and 2 days lieu".
