No employer likes to hold their hands up, as it could potentially make them liable to pay you money.
You can appeal and set your side out. However when appealing I would make it a rebuttal to the failures of the investigator and draw their attention to the point of law.
The appeal generally is held by someone higher up than the previous person.
For reference most employers will just say you worked their, our of fear of being held liable for all sort of torts.
