  • Gross Misconduct No Further Action

    Hi all, So my situation is I was suspended from work almost a year ago on allegations of gross misconduct. I was signed off sick during the suspension as I knew the allegations were not true. This has affected my mental health and has also led to chest pains due to stress and depression.

    I have been having issues with my new managers since 2019.
    Basically I was told there would be no further action as I refuted the allegations - I was rude to a client but this did not happen and I refuted this with proof.

    Whilst I was suspended I raised a grievance against multiple managers.

    Discrimination - I was referred to Occupational Health and was advised my OH I would require equipment to WFH. My managers did not supply the equipment I was required (this was raised three times by me), instead I was forced to work in the office alone for the rest of the year, whilst other employees with health conditions were allowed to WFH.
    Other staff were allowed to take lunches at 3pm to collect their children from school, I was told I was not allowed to.
    I was told to work in the office when it snowed, but everyone else was allowed to WFH.

    Unfairly managed - I met all my objectives in 2020 2021 2022 but was told in two of those appraisals I was given the rating "Need improvement". I had negative put in my appraisals and had unfair issues raised against me.

    Unprofessional - my managers were unprofessional and were talking about drinking whilst working on the internal messaging group. Also mocked GDPR and other things a manager should not be saying. Also swearing at me in 1:1 meetings.

    Harassment and bullying - I am not treated the same as other staff and my manager has made errors when it comes to monitoring my work.

    GDPR - My manager emailed me personal client information to my personal email.

    The grievance said no action would be taken but the managers in question all left.

    This week my gross misconduct was quashed the report said we found no concerns regarding your ability to undertake your role or conduct. I had witness statements stating that I was treated differently and that I was professional, hard working and had integrity.

    I was previously had a misconduct case in 2020 too by the same managers, this was for logging onto my laptop outside of work hours, again everyone else was doing this - so there was no further action.

    This has been a long term targeted campaign against me, what legal action can I take? Any advice is gratefully received.

    You mention a grievance you raised whilst you were suspended so presumably in the last year, what allegations did you raise?

    Have you now been reinstated at work?

    You mention discrimination, do you have a medical condition that falls within the Equality Act definition and if so was your employer aware of it?

    When did the incident regarding the equipment to work from home occur?

    Why do you believe that you have been harassed and bullied and when did these instances occur?
