In my job I have to ad hear fully to driving regulations as well as my employment contract. In 2023 I was being asked by my employer to extend my working time which required a workforce agreement in place. I asked if they had one in place and told yes. I asked for a copy of it and did not recieve one.
Some months later one day I went in to work and was told id made them aware they needed to impliment a workforce agreement. I was order there and there to sign a piece of paper. no discussions.
The Traffic commisioner and DVLA have told me if the company did not have a workforce agreement in place the company would have been breaking the law and I could be fined for breaching driving regulations.
The Traffic commissioner has told me a company cant just get someone to sign a piece of paper to create a workforce agreement. However my company tells me ive signed one so it is in place.
So if one has been incorrectly set up . does that mean one is in existance but not done correctly or does it mean as it was not done properly it does not exist.
Its fundermental to my position. I am being told to extend my working hours and for instance on wednesday I am attending a disaplinary hearing after work. to attend this I need to extend my working hours which requires a valid workforce agreement to be in place. or ill be in breach of driver regulations which is why im in a disaplinary.
