I believe I was subject to constructive dismissal but unfortunately I resigned in February so it's too late for me to challenge this. Is there perhaps an issue of a breach of contract I could challenge them on?
A brief summary of the situation is I was recruited as an apprentice on the basis I could complete the academic side of things in work hours - hence my reduced pay. Long story short I was not afforded this, and was expected to work 50+ hour weeks and then go home and complete the academic side of my apprenticeship. After much back and forth, and with Emails from the company agreeing to allow me time in work to complete, then further emails reneiging on this, I finally had enough and resigned as I couldn't take the stress anymore.
I have a welcome letter stating I would be given work time to complete, plus the apprenticeship agreement to this effect. Although my actual contract doesn't stipulate anything about learning etc as it was just a standard contract for non-apprentices so was worded the same, apart from my pay was reduced until completion of the apprenticeship whereby I would then receive 100% pay.
I would like to know if there is an opportunity to challenge this behaviour?
I stated in my resignation my reason to leave was not being given time as agreed.
I wish I had challenged sooner to be honest, but I didn't realise this was an option to me.
