  • Kings Coronation Bank Holiday

My partner's employment contract says that he is entitled to 28 days holiday including the 8 public holidays which are specifically mentioned. Of course, the King's Coronation (8th May 2023) is not mentioned, neither is there any provision for what will happen in event of additional days.

The company never communicated to staff that this day would need to come from the 28 days entitlement, and therefore they'd get less days effectively this year.

The office was closed so there was no opportunity for employees to work. They were effectively forced to take the day off.

He's now resigned and this day has been deducted from payslip as holiday pay.

    Is this lawful?

The contract of employment is specific to the usual 8 public holiday it does not state "all public holiday", this might mean an employee will not get an additional day's holiday.

However if the company was requiring employees to take holiday to cover the company closing for the day they should have given staff a minimum of 2 days notice this would be the case.
