  • Sick Pay Help

    I was diagnosed with stress and mental health issues due to my work and situation ongoing with work. I took 7 days self cert, and then have been signed off for 2 weeks with a fit note.

    I was checking my employment contract for whether I will receive my full salary during this time, it states I am entitled to receive the salary and other contractural benefits due for a maximum of 26 weeks in any 12 month period.

    I’ve attached a segment of my contract, have I got it right that I am entitled to normal full pay during my absence and that SSP applies after a 26 week period.

    You need to have complied with clause 13.1 in terms of notification regarding sickness absence, then it is 26 weeks as an aggregate in a 12 months period during which you are entitled to salary and contractual benefits.

      Hi, thank you - just to confirm I have complied fully with 13.1 - So in theory I would get full pay while on sick leave?

        If you meet the 26 weeks in an aggregate 12 month period criteria as well. This is my interpretation but you should discuss this with your employer.

          Sorry, if I meet the 26 weeks in 12 month period? I have only been off sick for 1 week self cert and now 2 weeks in total and no previous illness / or sick leave.

            Then you should be ok for being paid salary and contractual benefits, but as I have said confirm this with your employer.
