  • Not exactly a legal question but just wondering

    I am a sales director for a SME. I have been running the sales and marketing teams for the business for 3 years. Our CFO moved to CEO about 9 months ago. Over the last 6 months, he has been micro-managing everyone, and me as well as constantly undermining my position - I have kept a record of all of the instances. It started with him doing his own sales development, taking over my complex sales deals, and then removing me from comms. A final straw has been made where I've been informed via email that he's going to be taking over the marketing teams and I am to hand everything over to him. The CEO does not accept criticism well and always fires something back and I foresee that as a new CFO is coming on board he is trying to fill out his role. I am at a loss as to what my next steps are. There's nothing illegal going on and I am not a victim. Does anyone have any advice? The CEO is slowly becoming unapproachable. What's the best way of leaving if I take that pathway? I actually have a 6 month notice period but if I did hand my notice in, I'd like to go on Garden Leave which is built into my contract - I am actually considering telling them that I'm going to work for a competitor.

    Does you contract require you to disclose the competitor? Sometimes they do. If yours does the 'competitor' line will only work if you actually have a job with one.

      You may also want to check your contract for any restrictive covenant clauses in your contract.

          There are restrictive covenant clauses however they are focused around 1 business segment and I believe there are other areas I can use. It states if i am put on garden leave, that the covenants will start from that period and they are all 6 months?

            I do feel like I am being managed out of my job - are there grounds for filing a grievance? I also have never been given or seen our grievance process.

              If you are considering a grievance then firstly check your contract that may tell you where to find any grievance policy the company may have and if not then I would ask your HR department for a copy. Although raising a grievance against the CEO may not be an easy thing to do.

              If they are bringing in a new CFO will your reporting line change, if so not ideal but can you see if things change?
