  • Contract hours and pay resignation

    I started a job on 19th June 2023. This was for a cleaning company for 35 hours per week. She updated my online work account satiating working hours were Monday to Friday 9-5.
    on the 19th June- my first day, I got to the pick up point and she told me herself and her supervisor was ill so no one was available to train me and to take the day off. My second day the same happened.
    the 21st June I actually started. Throughout the last 4 weeks, she has been giving me pick up times of between 7:30am- 8:30am to travel upto 1.5 hours away from home to start work. Then my work has been between 1-6 hours a day and then travelling back again. So I am leaving my house for upto 10-12 hours at a time, but only getting paid for hours worked. So pay wise, I’m only getting maximum 24 hours a week despite being contracted 35.
    I finally got my contract on the 14th July and then she messaged to say she has put my contract hours down to 25 a week. So I told her I was not happy in this job and would like to leave and find another job.
    On 17th July I asked to go to doctors the following day and she told me no, to rearrange after work but I finish at 4pm and wouldn’t get back to my home city until after the doctors shut. So I told her I would not be returning to work after that day. I had not signed the contract by then as I told her I was not happy with the hours change and not getting the correct hours.
    Am I in the wrong that she should be paying the full contracted hours or am I in the wrong for walking out in my notice period. Notice on contract was 1 week but I had not signed and had been there less than 1 month. Can anyone shine some light on this for me?

    If your contracted hours are 35 per week then that is what you should be being paid, unless a variation to that contract is agreed with you.

    Effectively you have resigned verbally, even if not in writing, by saying that you will not be returning to work after that day which was not in accordance with the contract which requires you to give 1 week notice.

    However you are in the situation where you have left the company and now you need to ensure that you are paid what you are owed in salary up to the day you left.
