  • Employment Tribunal Advice - is my gut right?

    I am taking an ex-employer to an ET for Unfair Dismissal (England) as a LiP.

    The ET issued orders for providing details of losses, disclosure and witness statements plus a hearing date.

    I have received another letter changing the hearing to a prelimenary hearing but none of the orders have been change.

    The respondents solicitor has written to me saying we should agree to essentially ignore the the orders because they'll be update anyway.

    Obviously I want to act fairly but my gut is telling me they are just trying to draw things out.

    I will have all my evidence and witness statements ready to meet the orders.....what should I do?

    Can I just check what is the date of the Preliminary Hearing and what was the date on the original order?

    Is there anything complex about the unfair dismissal?

    Did you get your claim in on time?

      Hello,

      The hearing was set for November with the Orders for statement of losses, July 21st, Order for disclosure of documents Aug 3rd Aug and Order for Witness Statements Aug 17th.

        For a Nov hearing some of the dates like exchange of witness statements (WS) next month seem a bit strange i.e. I would expect to see them later an nearer to the hearing date.

        Can I suggest that you telephone the Tribunal to check with them that the recent correspondence converting the hearing from what was scheduled to be a final hearing to now a PHR is correct. Be prepared that you may have a bit of a wait on the phone, depending on the Tribunal your claim is being run from, some are quicker at answering the phone than others.
