Looking for someone to offer a perspective on my current employment issue please.
I have been employed by an organisation since September 2021, in November 2022 I quit my position due to stress relating to the birth of my son, long working hours (62+ per week) and difficulty completing part-time studies.
In December 2022 I met with my employer in a neutral location and was invited back to work under a newly created and contracted role, with reduced hours and less travel to recover my work-life-balance.
Since my return, my role did not come to fruition and I have been doing my old duties with similar hours and difficult working conditions. I have recently seen a deterioration in my mental wellbeing and have been accessing crisis services for depression, anxiety and suicidal thoughts.
I am currently self certificating sickness from work, and have been advised by my GP to be signed off and start a course of medication. I feel I have no choice but to resign from my new position once again as my employer have not accommodated my needs as agreed in my new employment contract.
Upon seeking legal counsel, I was advised I may be able to pursue a discrimination claim against my employer for their failure to uphold their end of the contract and accommodate my needs as agreed.
Please can someone advise if this appears to be a valid reason for pursuing such a claim?
