  • No ET3 Response From Tribunal

    Dear All,

    I am new to the forum and hope someone may kindly be able to suggest my next step in a tribunal case.

    I submitted my ET1 form in January 2023 and received a response stating it had been accepted and sent to the respondents on 6th February 2023.
    I have spoken to the tribunal who have confirmed that an ET3 response was received by the 6th March 2023 and has been sent to and returned by the judge with case management directions.
    My issue is that I have not yet received a copy of the ET3. I contact the court on the 5th of April, 12th of April, 28th of April and 9th of May but each time they tell me I will receive a copy but they can't say when.

    I have a preliminary hearing on the 17th of August and want to take legal advice on their response as it is a complex case but I am away during the last 2 weeks of July and my solicitor is away for the first 2 weeks of August, so time is running out. Should I keep contacting the court? I have heard nothing further from ACAS regarding the respondents and conciliation process and I am not sure what to do next.

    Any help would be greatly appreciated.

    It is the Tribunal who would provide you with a copy of the ET3, however have you already instructed the solicitor, in which case have they gone on record with the Tribunal as acting as your representative?
