Before starting a new job just over a year ago, there had been problems with a member of staff who, after moving to another department, left and found a job elsewhere.
Now, the situation is that she has applied for the same job, which would mean working with me. It would be the two of us only. She has friends in the workplace in other departments whose behaviour has been difficult and caused stress to other member of staff. A couple have resigned as a consequence and one in particular because of the expectation that this former employee would re-apply.
My question is, would this situation fall under "duty of care"? Could I speak with HR and point out that if they did re-employ this person, they would be failing in their duty of care to other members of staff who would have to work with her? Thanks.
