  • Change to Pay cut off date.

    My contract states I'm paid on the 10th of each month for the period of every day of the previous month.

    The want to change the cut off so we still get paid on the 10th, but the cut off date for the pay run will be 3 working days before the end of the previous month.

    Take this month for example; any work I do tomorrow - Tuesday 28th would go into April's pay instead of March's.

    Because of the nature of the work I do this could cause a large amount of money to be 'delayed' by six weeks.

    When I challenged this stating what was in my contract I was told as we were informed of the change in advance of it, it does not count as a breach.

    I haven't agreed to the change, nor does my contract state that a change can be implemented.

    HR are adamant that they're correct and we've reached an impasse. I'm not sure on my next steps?

    Changing the pay date and parameters of your pay from what is set out in your terms and conditions of employment will require consultation be that with employees or a union. Generally the consultation process will happen well enough in advance to give staff enough notice of the change and establish whether any support is needed as part of the transition to the new pay date. Effectively the transition period will be one month.

    If you do not agree the law does recognise that employers have to adapt to changing business needs and that sometimes the contract of employment must be varied to reflect this. If you do not agree to the changes, then you must make it clear to your employer. You should do this in writing, by way of a grievance,

    If you do not tell your employer you disagree with a change, this will be taken to mean that you have accepted it, you should therefore do this straight away, or as soon as possible after the change has been introduced.

    You can continue to work 'under protest' for a while but you cannot do this indefinitely without taking further action. Alternatively you can work with your employer to see if there is anything they can do to support you over the transitional first month and agree the change.

      Thank you. I will do this ASAP.

      I think the waters may also be muddied somewhat as my contract states I am a 'Casual Worker' and that any changes to the agreement cause it to be cancelled and a new one issued.

      However HR also stated to me in writing that because I am required to attend a location at a set date and time this makes me an employee. I going to seek further clarification from them.
