  • COT 3 Settlement Agreement

    I have a current tribunal claim. I transferred under TUPE and brought claims against the transferor and transferee. It later transpired that the liable party is the transferee. I subsequently withdrew my claim against the transferor as part of a COT3.

    My question is "Does signing a COT3 prevent me from calling witnesses from the transferor"

    The transferor employees that were responsible for the acts are the only witnesses and their evidence would assist in my claim against the transferee.

    You would need to read the terms of your COT3 and without any detail I can only respond on a general basis. The COT3 I presume, will include you not making any further claims against the transferor and the continuing ET claim is against the transferee. In theory you may be able to ask employees from the transferor to be witnesses, however given the situation they may not want to be called as witnesses.
