  • Back pay entertainment during notice period

    In October 22, my employer and union settled on an agreed pay increase to be effective from 1/11/22, and for all workers to receive back pay from April 22 I am due the new salary and my back pay on my salary date on 30/11/22. however, I have found another job and the start date is 5/12/22.

    If I put my notice in on the 18/11/22 with a required leaving date of 2/12/22, will my employer withdraw my back pay and or new pay increase?

    In theory yes you should, however there may be some clause negotiated into the agreement about staff being on notice when the payment is due and therefore not being eligible. It would not be the first time I have seen that.

    I would therefore check the detail of the agreement.
