  • Holiday dispute

    Hi hopefully this is the correct place to be posting this. I was looking advice on a dispute I’m having with my employer about holidays. We have a holiday booking system at work and can book off holidays through an app, the entitlement column on my profile told me I had 3 days entitlement left so I booked 1 day off and on returning to work my entitlement column was now reading -3 when I questioned this I was told it was a fault when updating the computer system and I had already used my full entitlement and that I now won’t be receiving full holiday pay at Xmas to account for the 3 days that I apparently owe? Can anyone give me any advice on if this is legal surely if I booked what I was told I was entitled to I shouldn’t have to be out of pocket further down the line? Any help will be greatly appreciated.

      Yes I have a record of holidays taken. Although the records match up with the days I have taken it will now leave me 3 days short to cover an 8 day Xmas holiday closure.

        Just to be clear, are you saying that you have taken more holiday than your entitlement?

          No I currently haven’t taken more but a company closure at Xmas will result in me taking 36 days instead of my entitlement of 33 so as a result they have suggested I only get paid for 5 days at Xmas instead of being paid for 8. Sorry hope that makes sense

            If I understand correctly, you appear to be saying that you did not keep track separately of the holidays that you have taken, but relied on the records shown in the company's app at the time you booked holiday. If correct information had been given, would you not have taken some of the holidays that you did take?

            You might run that argument with your employer; I suspect you already have.

            I think that the likely outcome is that you will have to take 3 days of the Christmas/New Year closure unpaid.

              Yes that is correct I booked off some days as I thought I still had entitlement remaining. Thank you for your help
