I have a judicial mediation coming up, for which the other side is preparing the bundle. I have passed on my disclosures but they have stated that there are too many pages and they will omit them. Are they allowed to do this?

Also, they have been unwilling to confirm if, for some documents which I asked them to provide, whether or not they are not located because they haven’t looked or what, if any effort went into trying to find them. Would these types of issues be too petty to bring before the judge?

    Many thanks

Tell them that in that case you will take 3 sets of your documents with you to the mediation - 1 for you, 1 for them, and 1 for the mediator.

      Unfortunately it’s a virtual hearing…

Then do it virtually. Prepare a pdf bundle.

Sams111 just to say,if you have not already been provided the detail, when being advised it would be virtual, about how to get the bundle electronically to the Tribunal, you will need to get in touch with them and ask how they want this sent over for the judge. There is still some inconsistency across Tribuanl offices as to how they want electronic bundles sent to them.
