  • To enforce award from ET with Respondent with false name

    I have been awarded compensation by an Employment Tribunal. However, I have not been able to enforce this award because despite long searches I have not found any information about the Respondent enabling me to enforce this award.

    However, by chance I have discovered that the real name of the Respondent is slighy different than this that he gave to the Companies House and that I used to issue my claim. This respondent who is a disqualified director used two names in the Companies house to incorporate companies his real name and a name slightly different than his real name.

    I would like to know if I have to make an application to the Employment Tribunal to issue another judgment in my favour changing the name of the Respondent or I can enforce my award to the County Court informing it that of the real name of the Respondent

    I am not sure how you managed to pursue a claim without having the correct name of the respondent. However, the below link will give you the details of how to try to get your compensation.

      It is why I wondering if the only solution is to make an applicatin to the Employment Tribunal to have the name of the Respondent changed

        I am not sure how you can enforce an order against the incorrectly named respondent if it is an individual rather than the company. I would suggest that you contact the Tribunal direct (you may need to spend some time trying to get through on the phone) and ask what they advise you do.

        If they say you can still enforce the award even if the name is slighly different then you can follow the procedure outlined in my post #2

          It is the county court which enforces the awards from the Employment Tribunal. I was thinking to the possibility that the Employment Tribunal amends the judgment in my favour following an application that I make including evidence of the real name of the Respondent.

            The County court enforce but it has to be against the name of the respondent as set out in the order from the ET. If this is incorrect then you need to ask the ET what can be done about it hence the reason for me advising that you to contact the Tribunal to ask what you need to do to get the judgement amended. At the very least you will have to be able to prove the respondent you named on the ET1 is the same person as you are trying to now enforce the judgement against.
