Both employer and employee agreed on final terms, conditions and value of Settlement Agreement and redundancy payment and signed SA 12 months ago. No outstanding costs/debts/loans were brought to the table during negotiations by either party. Ex-employer now stalling/unwilling to proceed on 1 final expense in the settlement agreement (relocation/demob flight organisation and expenses to be performed and paid by employer) as employer has remembered an amount was given to employee for accommodation deposit (9 years ago) . Can ex-employer reopen SA and claim from ex- empoyee? Or present a new claim?

I am a bit suprised that a signed SA of 12 months ago still has outstanding payment due as part of the Agreement this amount of time later. Not something I have come across before.
It will depend on the terms of the SA as to whether, given what appears to be the length of time for the payments to be made, there is anything that refers to changes of fact upon which the settlement is based allowing for a variation to subequent payments.If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com
