  • Term time + 2 weeks

I currently work school Term Time plus 2 weeks(10 days),I was due to work one of my extra weeks in the past half term holiday however I came down with a flu like bug I was advised to self isolate by the NHS and told to get a PCR test which I did and the result were thankfully negative, during that the testing time and waiting took 3 days which I missed off work.On return to work I had a return to work interview which was all ok and my documentation was presented,I was paid occopational sick pay for this time off.Now I am being told that I still owe 3 days .
My question is this right as I have been paid sick pay for these days therefore classed as worked?

Was this after 24 March? I know at that time there were changes that meant the legal requirement to self isolate even if you tested positive for Covid were removed.

I am wondering if this is causing confusion over the requirement to pay you occupational sick pay. I am presuming that if you came down with flu symptons, regardless of whether this had been Covid, did you feel well enough or not to work? If you did not then you were still off sick for reasons of the flu symptoms you had in which case depending on your occupational sick pay policy rules you are potential due to be paid under those arrangements and would not owe back the 3 days.

My answer has made some assumptions based on the information in your post but in any case it would be worth you speaking to HR or a manager about this.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.

I presume that you correctly reported that you were going home because you felt unwell? In which case I would suggest that you speak to HR or a manager about this.
