  • Under Investigation and mental Health

Hello-Last year a now ex colleague hacked my personal messages and circulated them. I was put under an investigation and received a final written warning, The employee left, but then started to clond my fb page and posted her own 'obituary' on my page. Since this first happened, and before I knew my account was being hacked, I have been subject to a horrible atmosphere at work and my mental health has suffered.'
I have EUPD and an Occ. Health report. My boss knew I was struggling, but kept encouraging me to work as we are very short staffed. I made a dreadful error a few weeks ago and was immediately suspended. I then went off sick. On the day I was suspended, they offered me 3 months pay to resign. I just don't know what to do. I stupidly have no union, but the employer has put 4 issues on my disciplinary. Most of them I am SURE I can defend as being caused by my mental state at the time. I have texts to/from my boss where I said I was struggling and just 'couldn't do it', but he just kept pushing me to get to half term. (Teacher). I'm lost. Completely.

Was the final written warning connected to safeguarding ?
Your ex colleague's action seems criminal to me.
Have you spoken with Authorities HR ? Is it an Academy ?
One of the professional associations may still help you.

They were unable to use the messages, so instead, they accepted another colleague's allegation that I had made 'inappropriate' sexual comments on a night out. As it happens, this allegation was from the hacker's friend. My boss was keen to wrap things up and move on and asked me not to appeal.
It is an alternative provision for 14-16 year olds overseen by a college. The actions WERE criminal and I find it very difficult that the college allowed ANYTHING from this woman, or her friends to be admitted.

I am now under investigation as I caught a child smoking dope on school proper and he would not give me what he said was a roll up. It ended up on the floor and instead of sniffing it, I put it to my lips (Did not inhale) to check, as he said the smell was on his tracksuit. It was a stupid action, but again, I can prove that I was under severe mental strain at the time. They are also trying to say I drove to work whilst unfit to do so (Sedatives) and I threw out tea and coffee belonging to the college. It is obvious to me they are desperate to get rid of me.
      Thank you.

I dread to think what might have happened to me as a young teacher if my activities, nothing criminal, out of school had any affect on my professional life ! I went on to become a headteacher.
Your management team has failed you. It must be a very stressful teaching in alternative provision. They have a duty of care to you. Are you able to take a more active stance ? Could you make a complaint to your Education Authority ?
The allegations don't appear to have any evidence. I would try to get a free initial consultation with a solicitor specialising in this field. Perhaps libel law comes into this.

Thank you so much. It has been a dreadful year and ,as much as I do think I have been supported a little, I don't think anyone stopped to think about the repercussions, because of the circulation of messages and the hackers own additional claim of sexual 'assault, I have faced, since September, rooms going quiet, comments, looks etc etc and I have never, ever been allowed to address the allegations, nor apologise for the messages the woman circulated, that were seen. My boss, who leaves soon, sat me down a few weeks ago, with tears in his eyes and said 'I have done you a huge disservice, I shouldn't have convinced you to keep going.' I absolutely adored my job, and was trusted and thought highly of, by the kids. I also, thought equally highly of them.

I am so glad you went on to be a headteacher. Thank you.

Hope you are coping. Just noticed top right corner the offer to scrutinise employment documentation. The people running the forum are marvellous. Perhaps ask for their help ?

Go back to forum home page. Top right hand of page refers to employment disputes and gives an email address admin@legalbeaglesgroup.com. Might be worth sending a brief summary to see if they can help.

sorry I have only just picked up this thread. I spend most of my time in the employment area of the forum.

Can I ask how long have you been employed under your current contract?

Have also moved thread to the employment area.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.

Hello. I have found help here before and now there is a change in my position. I was suspended from work and was signed off sick immediately afterwards. The investigation was supposedly put off, but it has now transpired that on the 2nd of March my job was advertised publicly on social media. Surely this throws the integrity of any investigation and procedure into some doubt? Any feedback would be greatly appreciated.

As part of the suspension you should have received confirmation of this action and notification of a person who would be your point of contact whilst suspended. I would suggest that you email and ask then about the situation, explaining that you have been alerted to an advertisement placed, apparently for your role on social media, earlier in the month. It would be very helpful to see if you can get a screenshot of it. If you have not been given a contact person whilst on suspension I suggest you contact HR.

How long have you been employed at the work at the college?

I do feel that this is related to your previous thread and therefore they should be merged just as is is more helpful for those of us advising.

Many thanks. Sorry, I am not very good with tech. Yes, I have screenshots and a point of contact. The answer is that is not my job, but something else (It IS my job) and as the union advised me they would probably say, they have claimed an error in the listing. I have emailed my point of contact and said how glad I was able to point out an error that has been online for 3 weeks Sorry for posting things in the wrong place. Thank you.

No worries, forums can be a bit confusing.

It is good to have a paper/electronic trail of these things. I presume that you investigation is still on hold whilst you are off sick. I hope that you are getting the necessay medical support for the time being.

Many thanks. I have seen an RMN and am now awaiting appointments for a course of therapy. Since speaking, and then emailing, the point of contact the advert was removed yesterday. I do feel that the outcome of any investigation is a foregone conclusion. I am following the job vacancies carefully, as I think that my employers have been a bit unwise. If, when the investigation is complete I AM dismissed and they immediately appoint a replacement from the removed advertisement, then it is possible I do have grounds for redress, as it is slightly dubious. This will be further evidenced I think, if they do NOT advertise again until I am dismissed, and the position is quickly filled, as it means again that the job has been filled from the original advertisement, which, I have in writing, is 'NOT' my job.

I have stated that really, given the behaviour I have encountered over the past year, that I do not particularly WANT my job, as everything I have experienced in the past year, has had a very bad effect on my mental health. I do have a meeting on the 30th where the point of contact wants to discuss my health again and the next steps in the investigation. They have, however, also misled me by saying that it was postponed, as this is not the case (

                            Many thanks. again.

I think given that you have a date later this week for a meeting to see what the outcome of that is and then consider what the next steps need to be.
