  • Gardening Leave

    I have now been placed on gardening leave until mid next month but yesterday I have been informed that I have sent five company files (excel, ppt) to my personal address and that they want confirmation they have been deleted from my personal email account.... I have ignored the email as I don't want any come back either way - I simply want to receive the monies owed and move on out of this terrible situation I'm in. What are the chances of getting into hot water over this?
    I have tried to find out some more information about this but I can't find many cases that relate. Thanks in advance.

    I suppose it depends on the nature of the files,

    Are they confidential / can that information be exploited for profit?

    What does your T & C's say about the ownership of company files?

      Some pdf brochures, advertising budget and brand guidelines. The handbook states that everything is owned by the company.

          If this is information that is owned by the company as stated in your company handbook and you may also have a confidentiality clause in your contract regarding company information then, if you have sent these to a personal email address and the company has evidence of this, I suspect that you would need to comply with their request.

          The files need to be deleted from your email account and if you have stored them on a home computer or other device then again they need to be deleted. Once you have done that, then confirm to your employer that you have done so as requested.

          To not do this could as you say "land you in hot water."
