  • Redundancy Appeal - having cold feet

    Hello,

    I have a redundancy appeal meeting soon and I am not sure whether to proceed. I feel as though I have good grounds and wrote a strong appeal letter saying I did not feek it was a genuine redundancy based on several points (a new person was recently employed to do most of my work, I am the only one in the company being made redundant, I have not had a good relationship with my manager lately, I was told that my department was being restructed but that no decisions had been made as yet when in fact a recruitment advert for the new role was already live) but since I put my appeal in, my boss has been coming in, saying hello to the room in general, sitting next to me and not talking to me. If she wants something she emails me instead of speaking to me. I am finding this quite intimidating, and am now wondering whether to not go through with the appeal becuase if I was successful, I would have to continue in my job and I no longer feel I can do so, I have been feeling really stressed and worried about it all.

    Any advice very gratefully received.

    Not a great situation to be in, but don't get stressed over it.

    How long have you worked there?

    If you're getting attitude from the manager and trust has diminished then maybe withdraw the Appeal. There seems to be no good reasons to stay.

    In both situations (staying / leaving) you could raise an informal Grievance with HR, see if that helps. You could raise a Formal Grievance In writing regarding the treatment you receive from your manager.and basic communication has broken down. Also the conflicting information regards restructuring, yet the ad for a new role.

      It would be useful to know how long DollyDoo has worked there.


      If there was a lack of process during the redundancy consultation, which you have detailed as part of your appeal, then that is an employment law issue and if proven could lead to you being reinstated.

      I think the advice is just more on a practical level about whether or not you want to stay working at the company since, if your appeal is successful, then as I have stated they would need to reinstate you. Part of what you may want to consider is how easy will it be for you to get another job and will any time delay be covered by the redundancy payment you are being given by the company if you are due one (over 2 years service).

        Hello both, thank you for your replies. I did go ahead with the appeal in the end, just awaiting their decision. I have been there just under 2 years, but by the time the notice period ends it will be over two years and so I qualify for a small redundancy payment.
