  • Tribunal has begun!

    Hi all

    i attended my tribunal on Tuesday of this week which was originally allocated one day. I did think when it was originally allotted at one day it seemed short but not knowing the process as I had never been through it before I just accepted it.

    Anyway on the day the judge immediately acknowledged after reading all the statements that in all likelihood that this wasn’t going to be concluded in a day and that further time would need to be allocated.

    So the tribunal begun and I spent the entire day cross examining the respondents witnesses, which I must say went better than I expected. They tripped themselves up, contradicted each other, admitted to things they shouldn’t have and a last minute tactic they thought they could use as a pocket case argument completely backfired on them and they won’t be able to use it.

    I was naturally pleased with how it went and I can only imagine that they are equally as unhappy about the day.

    Anyway at the end of the day, the judge determined that the tribunal would need to be paused and that he would look to conclude with another allotted 2 days which won’t be likely until next Sept-Oct which is nearly a year away!!! I’ve waited nearly a year for the first date and there had been all sorts of delay’s before which will mean it will be nearly 3 years from when the first of the events in my tribunal were carried out!

    With that said my question is as it went so badly for them and now that they have to wait at least another 10 months for it to conclude, can they still look to settle or now that the Tribunal has begun they have missed their opportunity?

      I am sorry to hear that your alloted dates are not until the autumn next year, however I do know that the Tribunal system is very backlogged and this is not untypical at the moment.

      Settlement can happen at any stage during the Tribunal process. If on reflection they feel that, given how the initial day went, it may be better to consider settling at this stage then that may be an option they would wish to consider.
