  • Repayment of Apprenticeship Training Fees

    Hello,

    I am looking for advice for the below, if anyone can help?

    I have recently accepted a new job which will begin after Christmas, my current employer-funded around 2.5 years of a degree apprenticeship.

    When I started with my employer I signed a learning agreement stipulating to pay back the training funds for the course. Although at this point I also didn't know the government and lead provider contributed to the course.

    My employer, however, also signed a "written agreement for the delivery of apprenticeship standard that is co-funded by HM government via the skill agency". A clause in this agreement stipulates " for the avoidance of doubt, apprentices must not make any cash contribution for training that is specified in the apprenticeship standard, or be asked to contribute financially to the direct cost of training or end-point assessment for an apprenticeship".

    They also pay into the apprenticeship levy so I guess they would also be eligible to recover these monies.

    I of course know the learning agreement would usually be binding but which agreement would take precedent and would I have to pay back any funds?

      Can you confirm two things:

      1. When did your apprenticeship start?
      2. Has your employer made any contribution directly to your apprenticeship training outside of what has been co-funded by HM government via the skill agency?

        Hello, thanks for getting back to me, see response below.

        My apprenticeship started in September 2016 with another organisation which I left in December 2017.

        My employer has only made financial contribution towards the apprenticeship itself, alongside the lead provider, government/skill agency.

          My view is if all your apprenticeship training has been financed via the training levy your employer is paying then you should not need to repay these costs. However you need to check whether your degree is covered by the criteria that it is "training that is specified in the apprenticeship standard"
