  • Employer refusing to pay staff for bank holidays

    Small family run business.

    The boss is a very nasty chap and very difficult to deal with.

    One he has in the past refused to pay staff for bank holidays if they take too much time off sick; is that legal.

    Secondly he has been using CCTV to spy on employees instead of using them to monitor for theft of materials.

    Are the above legal?

    My husband might have to take 7 days off sick due to injuring his wrist, he's worried the boss will refuse him his next bank holiday.

    There is no HR department being a small company.

    There is no automatic right to bank holidays or to be paid for bank holidays unless it’s used as a part of your holiday leave.

      If your husband is a full time employee working 5 days a week then his statutory entitlement is 28 days’ paid annual leave a year. This is the equivalent of 5.6 weeks of holiday and his employer can include bank holidays as part of statutory annual leave i.e. 20 days holiday plus the 8 bank holiday days.

      In regard to sickness absence does your husband's employer pay for any sickness absence - doubtful from what you have said? If not, given he may be off for 7 days, then he would be entilted to SSP payments which would be paid when he has had at least 4 days off in a row (including non-working days).
