  • Disciplinary advice

    Any help would be appreciated

    On the 23/8/2021 I attended a disciplinary meeting for misconduct and was told a decision would be made and I would recieve an outcime letter within 14 days. As of 17/9/21 I still have not recieved an outcome. As it has been so long does that in any way effect the validity of the decision,. Should I request a copy or not say anything, I guess I'm hoping somehow the fact I've not recived a decision will void the outcome.

    I already have one live first written warning, and for that I never received an outcome letter, but was given a decision at the hearing. I requested an outcome letter from my line manager and also my HR dept and was told I'd get a copy sent but that was weeks ago and I still haven't recieved a copy, ny plan was to appeal the first written warning I recieved but as I never received an official outcome letter I held off and it never became a concern until I attended my second disciplinary which could potentially lead to a final warning.

    Would the fact that outcome letters haven't been received in anyway counter any disciplinaries I may have My obvious concern is that potentially I can be on a final written warning, even though I've not had a decision as yet on my second disciplinary, and be in a position whereby it would be very easy for the company to take me to disciplinary for a third time and I lose my job.

    I have been with my employer for 14 years

    You should be informed immediately as possible if a decision has been made on your disciplinary meeting : https://www.acas.org.uk/disciplinary...linary-outcome, if there was no action needed, they should have already messaged you or talked to you privately.

    So you should request again from HR and your manager a copy of that meeting and the final outcome. If not you may be able to put this forward as gross misconduct, where a serious lack of care on the HR and managers duties as you haven't received anything back.

    You should raise a grievance as you should be informed of a outcome and request the record of the disciplinary meeting.

    But that's from ACAS, you may get a more detailed response from a senior member of this forum.

      Thankyou so much for taking the time to reply, I'm going to get an idea of the way forward once I've gotten advice, putting in a grievence against my employer feels like I could open myself up to further scrutiny so very wary.

        Can you confirm when your first live written warning occured?

        I suggest that you write to HR and state that it is more that 14 days since you were to be notified in writing of the outcome of your disciplinary meeting and you are still not in receipt of this confirmation. In addition you should refer back to the date of your requests made to your line manager and HR manager for written confirmation of the first disciplinary, that you were informed this would be provided and you are still waiting this correspondence. I would also point out that given you have not received the letter confirming the outcome of the first disciplinary you have been unable to exercise your right to appeal.

        Suggestion - check your company's disciplinary process which should detail that confirmation will be sent in writing and giving you the right to appeal. If so it would be good to add into your letter/email that this is detailed in the company's disciplainary policy and has not been complied with.

        I would suggest that you sent this today and see what response you get.

        If nothing happens by this time next week then my suggestion would be that you raise a grievance about the process of non written notification of both disciplinary hearings and that this has not allowed you to appeal any of these decisions.

          Thankyou so much for your detailed reply

          My first disciplinary was back in June, I spoke to my line manager on the 19th August informing him that I had not recieved my outcome letter although I was given a decision at the hearing, I have a WhatsApp message as evidence, he asked me to call payroll which I did and was told they would send a copy but I never received.

          I will email Personnel and see what they say
