Hello,
I am a claimant taking my previous employer to employment tribunal for Unlawful Deduction of Wages. My hearing is due to take place in 5 working days time.
Due to both my ET1 and the respondent's ET3 containing errors, my ET1 was corrected by the ET Office and the respondent was given another 28 days to submit a new ET3. The respondent's deadline for this was 3 weeks ago.
I am yet to receive any correspondence from the tribunal about whether our paperwork has been resubmitted to a judge for checking. I haven’t received either the respondent's ET3 or their bundle of documents as part of discovery. I do not know what defence they will use. However, the respondent already received my bundle of evidence months ago, due to the tribunal instructions that we were given (I sent the respondent my documents as instructed - the respondent did not send theirs to me.)
I have emailed the ET Office for an update, but had no response. I have called several times too but the phone has just rung out for an hour. I appreciate it is currently the summer holidays and close to the Summer Bank Holiday, but I am genuinely concerned that I haven’t had any response or instructions.
Please can anyone advise me on what I can do, or if this is just the normal procedure to follow?
