  • Pilon payments during a liquidation

    Hi all. I hope you are well.

    I was made redundant 9 weeks ago, from a company that was entering into liquidation. I was given no notice and got no redundancy only told to claim it form the government. I have received redundancy pay from the redundancy payment scheme but I was given no notice and and dint not receive any PILON, despite working there for well over 15 years.
    I have been trying to find out how I can claim the money for the notice pay I should have been given. I have been researching all over the Internet but no solid information as of yet.
    If anyone is upto speed as to how or when I may be able to claim my lieu of notice pay that would be of a great help.

    I presume you were provided with a fact sheet (RP1) and the reference number for which you made the claim for your redundancy pay from the Insolvency Service?

    You will receive an email from the Insolvency Service once your statutory notice period has come to an end which in your case will be 12 weeks and this email should also confirm the start and end dates of your notice period. You cannot apply for loss of notice pay until you receive this email and for which you can make an application online.

      OK thank you for the reply, I have a few weeks to wait then, yes I filled a rp1 form on the day I was made redundant. I have since started a new job so will I lose out on notice pay as a result of working again?

      Also can I claim the full notice pay that I lost out on from the company in liquidation as a creditor?

        You should not miss out on your notice pay just because you have started a new job. What you will need to do is complete the online RP2 when you are sent notificiation that you can do this.

          OK I should get the rp2 form any day then. I fail to see how I can claim the money I would have got for pay in lieu of notice though, I will lose out on over 8 weeks pay from my old place due to working. If the company had done right and paid me at the time of redundancy I would have had the money and still had the new job.

          Can I claim the money owed that the Redundancy Payment Service won't pay me back as a creditor?

            Did you start your new job immediately after you were made redundant? If not and there was a gap between ending with the company that went into liquidation and the new company then when you apply online they will ask for this information and you should then recevie notice pay for the "gap" between the two jobs.

            In regard to your question about becoming a creditor for the remaining notice pay I am not sure how that would work but in any event I do know that there is a official order determining which group of creditors is paid first during an insolvent liquidation. When a company enters liquidation, each class of creditors must be paid in full before funds are allocated to the next.

            Creditors are ranked as follows:
            • Secured creditors with a fixed charge
            • Preferential creditors
            • Secured creditors with a floating charge
            • Unsecured creditors
            • Shareholders
