withdrawing a claim

I have filed two claims against my previous exmployer:
unfair dismissal and race discrimination

During PH (preliminary hearning) which happened last week, judge indicated that my race discrimination claim looks week and asked me to make it arguable at least.
Now thinking more about it, I also feel same.

Respondent's solicitor have asked for 2 weeks to provide an updated response to claim. They haven't yet sent response - however I don't know how much time they have spent on it so far.

What are the implications if I withdraw race discrimination claim (i want to continue with unfair dismissal claim)? and what's the process of it? shall i just email tribunal keeping respondent in CC or first inform and agree with respondent and then inform court?

Can respondent ask for cost order if I withdraw one claim? (saying that they have spent x amount so far for the race claim which wasn't strong)?

If you wish to withdraw the race discrimination part of your claim then you inform the Tribunal and the respondent in writing that this is what you wish to do. In which case this part of the claim, comes to an end, subject to any application that the respondent may make for a costs, preparation time or wasted costs order.

So yes, the respondent once you withdraw the race discrimination claim can ask for costs, however given that you have withdrawn at this stage and effectively following "guidance" from the judge in the PHR the amount incurred so far would be a lot less than a costs order for a week claim, further on in the process. It would also be down to a judge to decide whether to award costs to the respondent.
