    Hi,

    Need some advice.

    I've been working in my current role for over two years in administration, all I do is sit behind a desk and add/change student information on to the system as and when needed.

    I've worked for the same company for 5 years and changed roles a number of times due to government contracts ending etc but always worked within the same company and always in administration roles.

    When I first started with the company I informed them about my DBS, I had a conviction for downloading a file that contained indecent images. I was young and I made a mistake and spent the last 6 years trying to move on with my life. The company and HR was fine with the conviction and offered me the job because even though the college had students aged between 16-21 I wouldn't be working with them directly and they have safe guarding policies in place so there was no problem.

    That conviction is now SPENT, as of last year, and as far I'm concerned no longer relevant and I just want to move on with my life.

    My employer recently had a big DBS audit and when they saw that I had that conviction on my file, even though the conviction is spent it still shows up on an advanced check, combined with what they said was a recent policy and working practices change within the company, I was no longer allowed to do the job that I've been doing for two years.

    I've done nothing wrong, always did my job, HR were fully aware of the conviction I had, I'm not on any sex register or anything like that, I've been doing this job for two years but due to a policy change I'm no longer allowed to do my job, apparently.

    How is a policy change my fault. I feel like I'm being punished all over again and its really making me depressed.

    Can they legally just fire me?

    Can I just ask whether your spent conviction not protected as defined by the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (Amendment) (England and Wales) Order 2020?
