    Hello,

    To cut a long story short, I was dismissed from my job of 5 years. They used the excuse of redundancy but didn't follow any proper procedure and I have actual evidence they lied and just wanted to get rid of me.

    My question is around what could be achieved from an employment tribunal.

    My employer gave me some redundancy money - enough to last for a few months. Assuming I get a job before the money runs out, what more could the tribunal give me? What I would like is my job back but I presume they can't force the company to take me back? Even if they are found to have not followed procedure and I was wrongfully dismissed what could I actually get from taking them to a tribunal?

    Is it worth it?

      Was your redundancy pay in accordance with either statutory redundancy or if the company paid enhance redundancy the terms of that agreement?

      There are two things that would need to be established for you to make a claim:

      1. The company did not follow the correct process - procedural issues
      2. That redundancy was not the real reason for your dismissal - unfair dismissal

      The first stage of bringing any ET claim is to commence an Early Concciliation process via ACAS which is designed to try and get a settlement between the two parties. That could be on the basis of trying to get reinstatement, if you really want to go back to work for this employer after what has happened, or to try and get further compensation in addition to the redundancy payment you received.

      You should be aware that taking a claim through the tribunal process, if Early Conciliation does not work, can be tough and stressful if you are representing yourself and at the moment given the back-log in claims this could take well into 2022 to get any resolution.

      If you did want to make a claim and start the process then there is a time limit which is 3 months less a day from the date of your termination.

      That is just a quick overview and not sure if I have answered all or created more questions for you, if so just come back to this thread and ask them.
