  • Advice needed - job application/rejection

    Hi all,

    First post, hoping for some general advice!

    Recently an internal position came up for the company I work for, which is much better suited to me than my current role, and which I have all necessary qualifications and experience for. I applied, was interviewed, and the position ended up being offered to an external candidate. The feedback I received as to why I did not get the role was that our CV's were very similar, it was a very close call, and the other person just about pipped me to the post.

    I later found out this person is actually less qualified and experienced than myself, but I completely understand that in terms of the law, an employer can hire who they like for a role. So despite feeling a bit let down, I accepted the outcome.

    However, it has recently come to light that the person they chose for the position has now withdrawn and declined the offer, last minute. My question is: after feeding back to me that I was a close second in the process, are they obligated to now offer me the role? And would they need to have good reason to offer it to someone else? Or again, is it a case of, they can offer it to anyone they like?

    I think really what I'm asking is, would I have a leg to stand on to complain if they unfairly overlooked me now the position is once again available?

    Sure the answer isn't straight forward, but any thoughts welcome. Thanks very much!

    Have you actually asked whether having had this person turn down the offer they are still looking to recruit into the position?

    Does the company have a specific policy in regard to having to accept internal application for vacancies?

      Hello, thanks for your response.

      The company are definitely still looking to recruit into the position.

      As far as I'm aware, all internal applications are treated the same as external. I don't believe there is a specific policy on having to accept every internal application, however my manager was supportive of my application because I am well suited to the position and that was obviously recognised when I was shortlisted and within the final selection.

      I'm just wanting to know as 2nd choice, with the 1st choice person declining the offer whether (considering the feedback they gave me) they are obliged to now offer me the role, or whether it makes no odds.

        Unfortunately they are not obliged to offer you the position. However if you were the second choice, then I would hope they consider making you the offer unless they feel going out to external recruitment again may lead to an even more suitable candidate.
