  • Change of job but no new contract?

    I find myself in an akward situation and want to make sure I know what I'm talking about before It goes any further.
    I am handing in my notice at my workplace. I started on part time hours, I signed a contract then which stated I had to give 4 weeks notice upon leaving.
    In October this year I changed to full time and a different job role, however I received no update to my contract.
    my employer is now trying to tell me that I have to give 2 months notice to leave, because even though I haven't signed anything I have entered into a new contract because of the time frame?
    I'm thinking surely this cannot be right? She is also saying she can withhold my pay if I leave after one month?
    I don't think my new job will want to wait that long.

    So they cannot hold you to a contract that you have not signed or seen. You could point out that if the other contract was cancelled then by default you are only required to give 1 weeks notice.

    If your salary is withheld then you claim against them for unlawful deduction from wages
