  • Can an employer refuse to provide reference/confirmation letter of employment?

My husband is applying for British Citizenship - he would like to include a letter from his employer in his application to confirm that he works there full time and the date he started. The employer is refusing to provide that letter as he is in a probabtionary period (he started there six months ago - they have just extended the probabtionary period for a further two months) - they said he has to have a permanent contract to get any kind of reference/confirmation letter.

Could you tell me if they can legally refuse to provide such a letter?

    Thank you.

Is this needed for your husband to prove residency in the UK because his passport was not stamped on entry to the UK?
The actual question is would it be illegal for them not to provide it and as far as I am aware it is not.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.

Thanks ULA. His passport is stamped on entry to UK - we thought we would add the letter confirming employment as additional supportive documents.

Can you provide an alternative, such as payslips to show employment?

Yes, he has his P60s which I think will be sufficient.
