    Hi,
    I wonder if anyone could point me in the right direction.
    After 20 years of working for the same employer, a small company where each person had many hats, so to speak.. the MD sold the business. New Directors came in, changed many things (as to be expected) including my job, roles, responsibilities etc
    Sadly old employer was very old school and did not give out contracts.
    I am now in the court system and need to download something regarding not having a contract as part of my evidence.. (Express terms, implied terms - built up from expectations, customs and practices) as new employer's attitude is no previous contract means he can do as he pleases.
    When new contracts were offered around, I politely refused to sign and explained why.. (as did other members of staff too) contracts got withdrawn and eventually amended, but I have been accused of continually refusing to sign - so many other things, being held against me.
    I just need something definitive to state what is the correct course of action, moving from implied terms to new contract.
    Any help or advice much appreciated, thank you.

    Sorry to say old school or not you should have been provided a contract of employment by your old employer, however given that you were not, without details of the claim you are making, which I presume is an ET claim what are you needing to prove in regard to your "original" terms and conditions of employment?

    Also you say that you were provided a contract by the new owner of the business which you did not sign, did you explain your reasons for not signing? Did you say you were continuing to work but "under protest"?
    Did you raise a grievance about the new terms and conditions?
    Did you work for any period of time under the new terms and conditions and if so how long for?
