    Hi Ula,

    The police will investigate it now which is good. Please may I ask if you know how I can inform the Judge. The police said I should make sure they are aware but I don't know how to do that. Do I email the courts or speak to the Judge during the hearing?

      Glad to hear the police are dealing with it.

      Did you have to to prepare a witness statement (WS) for the PHR? If so sending in an amended WS which sets out what has happened might be a way to get it to the attention of the Judge.

        The police have been great.

        No I haven't had to do a WS yet. Could I ask for a postponement of the hearing perhaps?

          What you would need to do is make an application to the Tribunal for a postponement of the hearing, included in this you would need to:
          • State the specific reason(s) for applying for the postponement.
          • Explain why you consider it would be in accordance with the ‘overriding objective’ for the tribunal to grant the postponement such as (a) ensuring that the parties are on an equal footing; (b) dealing with cases in ways which are proportionate to the complexity and importance of the issues; (c) avoiding unnecessary formality and seeking flexibility in the proceedings; (d) avoiding delay, so far as compatible with proper consideration of the issues; and/or (e) saving expense);
          • If you have not discusssed this with the respondents and I presume in this case you would not, then you would need to state that you have not sought their agreement to the application and in any event copy the application to the respondent, notifying them that any objection to the application should be sent to the tribunal as soon as possible.
          • Provide supporting documents to support your application for the postponement.
          We may be able to find a way to use the recent events upon which to base the application.
