    Hello,

    I am new here and a bit desperate. I was made redundant the day after I received the ACAS EC number (21st of January). They had tried without prejudice negotiations (disability discrimination, victimisation, harassment), but when they saw I would not accept their offer, they made me redundant. I think I have until the 20th of February to submit the ET1 form, but please correct me if I'm wrong.

    I struggle a lot with filling section 8 of the ET1 form. Should I phrase it in 1st person or 3rd and talk about myself as the claimant? I've seen some examples online but it was stuffy lawyer speech. I've written 5 pages so far and I worry I might go too much into details. Is there a reasonable length?

    If I am not challenging the redundancy (less than 2 years with the company), how can I assess the injury to feelings award? Is there a scale apart from the Vento bands?

    Any advice will be appreciated.

    The ET1 must be submitted 3 months less a day from the date of your termination at the very latest but I would advise not to leave it that long.

    This is about you and your claim so should be in the 1st person and once/if you get to this stage then you will need to wrrite your witness statement in the same way.

    In terms of length it really does depend on the claim, however you must give sufficient details of your claim so that the tribunal and respondent can understand what your claim is about. You will need to describe the incidents which you believe amounted to disability discrimination, victimisation and harassment, the dates of these incidents and the people who were involved. You also need to explain in what way you believe you were discriminated against, victimised and harassed. It is best stick to the facts and leave out any "waffle".

    The Vento scale is the recognised guidance for Tribunals and although not binding, they must have regard to it and it would be highly unusual if a Tribunal did not follow them, so you are best advised to do the same.
