  • Consultation demotion

    Hello,

    looking for a bit of advice here. The IT department in which I work have gone in to consultation today. Amongst other roles we have 2 senior software developers and 8 software developers. They have removed both senior roles for which I currently fill one slot and replaced all to be ‘software developers’. The 2 senior posts will be moved to two new software developer posts. We bring along our current salaries (above what the other devs are being paid) but not the banding.

    so I have no headroom left in terms of performance related pay and the job role has less responsibility than my previous post.

    now whilst I’m grateful to still have a job at my current salary, this is a demotion in my eyes and I enjoyed the greater responsibility of my senior role. I’m assuming this has all been done legally? Or do I have a case for constructive dismissal?

    Based on your post, if this is being done as part of a restructuring exercise and you are remaining on the same terms and conditions of employment inlcuding salary I think it would be difficult to argue a case for constructive dismissal.
