  • Paying for Reasonable Adjustment

    An employee has developed a condition that is disabling under the Equality Act and the employer has made a reasonable adjustment to accommodate their disability.

    This has caused more work, increased the hours of, another employee.

    The employer wants to cut the disabled employee's pay and use it to cover the extra hours worked by his colleague. Is this discrimination?

    If the disabled employee does not agree to the pay cut and the employer removes the reasonable adjustment, what can he do? It appears that the employer is trying to get the disabled employee to pay for his reasonable adjustment.

    It is the employer who is responsible for making any reasonable adjustments they have agreed to carry out.

    If the employer could not afford the reasonable adjustment, then this could have been a reason for turning down the request or looking to see if they could agree some form of other adjustment which might have served the same outcome but have been within their budget. They could have also seen if the employee might have been able to apply for funding through the government's Access to Work scheme.

      Thank you Ula. Would the "government's Access to Work scheme" help to pay for disabled toilet facilities as there are none at present?
