  • ERA 1996 - Section 44

    Hello, Does anyone know if an employee would be protected under Section 44 of the ERA 1996 if they were to refuse to attend work due to lack of appropriate accomodations made to the working environment? The person in question would have a complicated medical history and was previously a recipient of a Gov Issues shielding letter.

    Depending on the medical circumstances of the individual and also the issue with the work environment then there is the potential for the employee to be protected under that section of the ERA 1996. However in all of these situations it all comes down to the circumstances.
