    i think my solicitor is incompetent

    looking for some advise as im going to tribunal for unfair dismissal in 2 days i have only just found out a subject access request and my question is should my solicitor have issued one of these near the start of my case? would that not be normal practice in the information/evidence gathering part of preparing for the case?

    also if we request this what is to stop the other party lying and withholding documents?

    An SAR is not always a necessary part of the process of exchange of documents. Generally as part of the Case Management Order both sides would have been asked to produce a list of documents they were going to rely on to support their case, any documents solely in the other party's possession would have required to be copied and sent to the other party. If there were any documents not forthcoming then a request could be made to the Tribunal to request that the other side be ordered to produce the documents.
