    Hi,

    I hope someone could give me some advice if possible if I can make a personal injury claim against my employer. I ended up resigning from my job this week due to stress & Anxiety caused by a mixture of my working environment and being micromanaged over the past two months* which has* quite frankly shattered my confidence. On June the 26th I opened up to my employer on the amount of workload they were expecting me to do and the stress & anxiety It was causing. Normally I would bottle these things up but because there is now so much awareness of mental health and welbeing, I thought I would open up to my line manager about how i'm not coping with the amount of work they are expecting from me. It feels like they expected me to catch up on* 6 weeks worth of work in a couple weeks which is not at all* possible. I asked* them that If I had someone to help me out* for a month* this would ease the pressure slightly but I was told this was not possible because the project I was working on* did not have an allowance for an extra body to assist me (bear in mind the company turns over* 3 billion pound a year)and because I was the lead supervisor on a project they expected to carry on.

    After a week or so went by then I started receiving a barrage of emails from my line manager requesting me to carry out tasks which normally takes two months but wanted turned around in a month. They* started requesting reports for all sorts of things, and everything I produced my manager* started commenting on things which pretty much lowered my confidence. My boss* started to get involved in meetings and started sending out emails 10 o clock at night. The last straw was on Wednesday when my boss* sent an email to me with unrealistic deadlines on things.I work in construction so H&S is a big thing, but it seems like this company I work for puts money before ones health & welbeing. I only joined the company in January and my probation was coming to an end at then end of the month.if they wanted to get rid of me they should of waited until my probation period ended.*

      Although it is possible to make a personal injury claim against your employer for stress, you can only do so if the stress-related illness is severe enough to warrant making a claim and a medical diagnosis has been made.

      Practically a personal injury claim may only succeed if you can show that your employer was made specifically aware of the problems you were experiencing at work and in particular how this was affecting your health. Complaints about excessive hours, excessive workloads or lack of appropriate training will not be sufficient. Your employer must be made aware that the work is actually affecting your health and hence the need for there to be a medical diagnosis. Should your employer then fail to take appropriate steps to address your workload or provide adequate training and resources they may be negligent and you may be entitled to recover personal injury compensation for any further symptoms experienced.

      If you did want to pursue this I would suggest that you consult a PI injury lawyer who specialises in stress at work claims.

        Just try to find a job you love! And you will be almost always happy when you are going to work. It’s very easy to get hit by option paralysis when you’re digging to find work you’d love, even for people like myself who already thought they knew.
        Taking an example from my own life, I sold ad space for a food industry publication for 2 months and got fired for… well, being sh*t at ad sales. If you’ve no idea what your ideal job looks like, try online therapy TrustSession. And they helped me a lot.
