    Hi there,

    Just wanting some advice around whether I have potentially experienced pregnancy discrimination.

    I have been employed on a fixed term contract since early January 2020. This was initially on a 3 month contract but I had been reassured early on that it was very likely my contract would be made permanent even when i informed my employer in late January that I had found out I was pregnant. I was then informed late February that my contract was to be extended again until early July 2020. Fast forward to June and a few weeks ago I was told that the company couldn't made me permanent due to various reasons such as 'headcount' and 'not knowing what the team would look like in a few months'. I was asked when I intended to take maternity leave (which I advised was early August) and they extended my contract to the end of July 2020. However, I was then verbally told that as soon as I wanted to return to work after having my baby, to give the company a call and they would take me back as they felt I was brilliant etc. etc. - even if this was as soon as September or October if I wished. I was a bit puzzled at this at this insinuated that there was work/a role for me at the company and contradicted what they had previously told me about not knowing what the team would look like and headcount etc. In addition to this, the project I am working on has been extended until October 2020 and I am certain that if I was not about to take maternity leave that my contract would be extended until at least the end of this project. I haven't had anything in writing confirming my contract ending yet either - should I expect this?

    Firstly the expiration of your fixed term contract should be detailed in the contract extension documentation. That is the whole basis of a contract being for a fixed term is that is has a start and end date.
    The non renewal of a fixed term contract is potentially dismissal and if you have been on a series of fixed term contracts for two or more years they will need to follow a fair process. However if the job still exists and the reason for not renewing is because of your pregnancy then potentially this will be discriminatory and automatically unfair since the two year qualifying period does not apply.*
